GilOrtega.net is the personal website of Gil Ortega and is operated by Profit Worldwide, Inc., a Nevada corporation ("PWI," "we," "us," or "our"). PWI operates several brands, including Chief Rainmaker, XLR, TravelXLR, LinkedIn Recruiting Engine, OBEYY Protocol and Rick Bliss.
These Terms apply to GilOrtega.net, its subpages, and any related form, email list, gallery or page that links to these Terms (together, the "Site" and the "Services"). Our business services are offered on ChiefRainmaker.com under its own terms.
Our Privacy Policy and Disclaimer are part of these Terms by reference.
02Accepting These Terms
By visiting the Sites, submitting a form, booking a call, creating an account, or purchasing anything from us, you agree to these Terms. If you do not agree, do not use the Site.
You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of a company or other organization, you confirm you have authority to bind it, and "you" includes that organization.
The Services are not directed to children, and we do not knowingly sell to or collect information from anyone under 18.
03Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Last Updated" date above and, for material changes, may also notify you by email or by a notice on the Sites. Changes take effect when posted. Continuing to use the Site after that means you accept the updated Terms.
Changes to the arbitration section will not apply to disputes that arose before the change. The terms in effect when you made a purchase continue to govern that purchase.
04What This Site Is
GilOrtega.net is a personal site. It shares Gil's stories, ideas, opinions, travels, books, art and the businesses he is involved in. Some pages link out to other sites, including ChiefRainmaker.com, XLRHub.com, GVSR.net, RickBliss.com, O2S1.com and blog.gilortega.net.
Opinions and personal experience. Content on the Site reflects Gil's personal views and experiences at the time it was written. It is not professional advice and may not be current.
Email lists. Some pages, such as the Travels page, invite you to join a free email list (for example, the travel monetization list). Joining is free and does not create any client relationship or obligation.
Products and programs. When the Site links to a book, course, program or service, whether ours or someone else's, the terms on that product's sales or checkout page govern that purchase.
Travel information. Travel stories, destinations and tips are general information. Always confirm prices, schedules, entry requirements, safety conditions and availability directly with the provider before you book or travel. We are not a travel agent and are not responsible for third-party travel services.
05Your License to Our Content
If you download or receive free materials from us (for example, through an email list), PWI grants you a limited, non-exclusive, non-transferable, revocable license to use them for your own personal use or the internal use of your own business.
Unless we agree otherwise in writing, you may not resell, sublicense, republish, rebrand or give away our materials; use them to train or build a competing product or AI model; or remove copyright or trademark notices. Breaching this section ends your license automatically.
06AI Tools and AI Output
Some of our products and programs run on third-party AI platforms such as Claude. Some images on the Site may be created or edited with AI tools. AI output can be inaccurate, incomplete or unsuitable, and you are responsible for reviewing anything an AI tool produces before relying on it.
PWI is independent and is not affiliated with, sponsored by or endorsed by Anthropic or any other AI provider unless we expressly say so.
07Purchases
The Site itself does not sell anything directly. If you buy a product or service through a link on the Site, the purchase is governed by the terms, prices and refund policy on that product's sales or checkout page, whether it is ours or a third party's.
08No Guaranteed Results
Nothing on the Site promises or guarantees any income, savings, travel deals, business results or other outcome. Stories about Gil's own businesses, travels and results describe his personal experience and are not typical. Your results depend on your own effort, skills, circumstances and many factors outside our control. See our Disclaimer for more.
Nothing on the Site is legal, tax, accounting, financial, investment, medical or travel-safety advice. Consult a qualified professional for those.
09Affiliate Links and Compensation
Affiliate Notice: I am often compensated for products I link to. It would be best if you assumed that any links leading you to products or services are affiliate links from which I will receive compensation.
This includes links to our own brands and to third-party products, tools and travel services. Buying through these links does not cost you more. We only share things we believe are worth a look, but you should always make your own evaluation.
10Email and Text Messages
If you join one of our email lists, for example the free travel monetization list, you agree that we may send you emails related to that list, plus newsletters, updates and offers from PWI and its brands. Our email is sent through our email provider (MailerLite). You can unsubscribe at any time using the link in any email.
If you give us your mobile number and agree to receive texts, you consent to receive recurring marketing and informational text messages from PWI at that number, which may be sent using automated technology. Consent is not a condition of purchase. Reply STOP to opt out or HELP for help. Message and data rates may apply.
11Intellectual Property
The Site and everything on it, including text, stories, photographs, artwork, logos, graphics, video, audio, and the design and arrangement of the Site, are owned by Gil Ortega, PWI or their licensors and are protected by U.S. and international copyright, trademark and other laws. Photos on the Site are personal photos and may not be copied or reused without permission.
You may view the Site and share links to it. Otherwise, you may not copy, reproduce, distribute, display, modify or commercially use any of it without our written permission.
If you send us ideas, suggestions or feedback, we may use them freely without obligation to you.
12Trademarks
Gil Ortega, the GO logo, Profit Worldwide, PWI, Chief Rainmaker, Code of Rain, RainWorks, XLR, XLR Hub, XLR OS, AffiliateXLR, TravelXLR, LinkedIn Recruiting Engine, OBEYY, OBEYY Protocol, Rick Bliss, CHILI Productions and Give Value, Sell Results, and related names, logos and designs, are trademarks of Gil Ortega or PWI. You may not use them without our prior written permission.
Other names and marks mentioned on the Site, including companies, products, destinations and venues, belong to their respective owners and are used for identification and reference only. Their mention does not imply endorsement.
13Acceptable Use
You agree to use the Site lawfully and not to: break any law; submit false information or someone else's email address to our lists; scrape, copy or harvest the Site or its photos by automated means; access or attempt to access systems without authorization; interfere with or circumvent security features; submit spam, malware or abusive content through our forms; or use the Site in a way that could harm PWI, Gil Ortega or anyone else.
14Communities and Your Contributions
Some Services include communities, live sessions or places to post content. Please be respectful, stay on topic and respect the confidentiality of other members. Do not post anything unlawful, defamatory, harassing, obscene, misleading or infringing, or any promotion we have not approved.
You keep ownership of what you post or submit ("Contributions"), but you grant PWI a worldwide, royalty-free, non-exclusive license to host, use, reproduce, display and share your Contributions in connection with operating and promoting the Services.
Live sessions may be recorded and shared with members. If you do not want to appear, turn off your camera and microphone or let us know before the session. We may remove Contributions or members at our discretion.
15Copyright Complaints
We respect intellectual property rights and respond to notices under the Digital Millennium Copyright Act. If you believe content on the Sites infringes your copyright, send our Copyright Agent a notice that includes: your physical or electronic signature; identification of the copyrighted work; identification of the material you claim is infringing and where it is located; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
If your content was removed and you believe it was a mistake, you may send a counter-notice meeting the requirements of 17 U.S.C. § 512(g)(3). Knowingly misrepresenting infringement may make you liable for damages. We may terminate the accounts of repeat infringers.

16Third-Party Services and Links
The Site uses and links to third-party websites, tools and platforms, including our website host, email provider (MailerLite), photo gallery and testimonial widgets, booking and contact tools, book and blog sites, affiliate partners, travel providers and social networks. We do not control them and are not responsible for their content, policies, availability or practices. Your use of them is governed by their own terms and privacy policies.
17Disclaimer of Warranties
The Site and all content and materials obtained through it are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, PWI disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
18Limitation of Liability
To the fullest extent permitted by law, PWI and its affiliates, officers, directors, employees, contractors, agents, licensors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or anticipated savings, arising out of or related to the Services or these Terms, however caused and under any legal theory, even if advised of the possibility of such damages.
Our total liability for all claims arising out of or related to the Services or these Terms will not exceed the greater of (a) the amount you paid PWI for the Services giving rise to the claim in the 12 months before the claim arose, or (b) $100.
These limits do not apply to liability that cannot be limited by law, such as liability for fraud or gross negligence.
19Indemnification
You agree to defend, indemnify and hold harmless PWI, Gil Ortega and their affiliates, officers, directors, employees, contractors and agents from any claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys' fees, arising out of or related to your breach of these Terms, your Contributions, your use of the Site or its content, or your violation of any law or third-party right.
20Disputes and Arbitration
Talk to us first. Before starting any formal proceeding, email info@profitworldwide.net describing the dispute and the resolution you want. We will both try in good faith to resolve it within 30 days.
Binding arbitration. If we cannot resolve it, any dispute arising out of or relating to these Terms or the Site will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, or its Commercial Arbitration Rules if you bought for a business, applying Nevada law. The arbitration may be held by video, by phone, or in person in Clark County, Nevada, or the county where you live. AAA rules govern the payment of fees.
Exceptions. Either of us may bring an individual claim in small claims court, and either of us may ask a court for an injunction to protect intellectual property.
No class actions. You and PWI each agree to bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not consolidate claims of more than one person.
Opting out. You may opt out of this arbitration agreement by emailing info@profitworldwide.net within 30 days of first accepting these Terms, with your name, your email address and a clear statement that you are opting out. If you opt out, or if the class action waiver is found unenforceable for a claim, that claim will be resolved in court under Section 21.
21Governing Law and Venue
These Terms and any dispute arising from them or from the Site are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute not subject to arbitration will be heard exclusively in the state or federal courts located in Clark County, Nevada, and you and PWI consent to personal jurisdiction there.
PWI is based in the United States and makes no claim that the Site are appropriate for use elsewhere. If you access them from outside the U.S., you are responsible for complying with your local laws.
22Suspension and Termination
We may suspend or end your access to any part of the Site or our email lists, without notice, if you breach these Terms or act in a way that could harm PWI or others. You may stop using the Site and unsubscribe at any time.
Sections that by their nature should survive termination will survive, including those covering intellectual property, disclaimers, limitation of liability, indemnification and disputes.
23General Terms
These Terms, together with the Privacy Policy, the Disclaimer and any product-specific terms, are the entire agreement between you and PWI about the Site and replace any prior understandings. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Headings are for convenience only.
